Terms of Service

Please read these Terms of Service ("Terms") carefully before using Signal MCAT (the "Service"). By creating an account or accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance and Eligibility

By using Signal, you represent that you are at least 13 years of age and, if between 13 and 17, have obtained verifiable parental or guardian consent. You agree to provide accurate registration information and to keep it updated.

3.1 Registration

You must create an account to access most features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3.2 Account Security

Notify us immediately at legal@signalmcat.com if you suspect unauthorized access to your account. We are not liable for losses arising from unauthorized use of your credentials.

3.3 Account Termination by You

You may delete your account at any time using the "Delete account" option in your account settings. Upon deletion, your personal data will be removed within 30 days per our Privacy Policy.

4. Subscriptions and Billing

4.1 Free Tier

Signal offers a free tier with usage limits as described on the pricing page. Features and limits are subject to change with reasonable notice.

4.2 Pro Tier

The Pro subscription is billed monthly or annually as selected at checkout. All billing is processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.

4.3 Cancellation

You may cancel your Pro subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. We do not provide pro-rated refunds for unused portions of a billing period, except where required by applicable law.

We may change subscription pricing with at least 30 days' prior notice. Continued use after a price change constitutes acceptance of the new pricing.

6.1 Our Property

Signal MCAT owns all rights, title, and interest in the Service, including the software, design, AI-generated mirror questions, and all other content created by or for us. Nothing in these Terms grants you any ownership rights in the Service.

6.2 Your Content

You retain ownership of any content you upload (e.g., screenshots). By uploading, you grant us a limited, non-exclusive, royalty-free license to process that content solely to provide the Service to you. We do not claim ownership of your uploaded content and do not store it permanently.

6.3 Third-Party Test Content

Signal is designed NOT to store verbatim MCAT practice question text or images. You are responsible for ensuring your use of the Service complies with the terms of any third-party test preparation provider whose materials you upload. We do not endorse, sponsor, or have any affiliation with AAMC, Kaplan, Princeton Review, or any other test preparation company.

7. AI-Generated Content Disclaimer

Mirror questions and readiness assessments are generated by artificial intelligence (OpenAI GPT-4o). AI-generated content may contain errors, inaccuracies, or outdated information. Signal MCAT does not guarantee the accuracy, completeness, or medical/scientific validity of AI-generated practice questions or assessments. You should not rely solely on Signal for your MCAT preparation. Always verify important concepts using authoritative study materials.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE MAKE NO GUARANTEE REGARDING MCAT SCORE OUTCOMES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIGNAL MCAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Signal MCAT and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right; or (d) any content you upload to the Service.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except that either party may seek injunctive relief in a court of competent jurisdiction.

YOU WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION WITH RESPECT TO ANY CLAIM AGAINST SIGNAL MCAT.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or prominent in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
